The offer and sale of all products on giomoretti.com are governed by the following General Conditions of Sale.

1. Enforceability of these conditions of sale
1.1 These General Conditions of Sale govern the offer, shipping and acceptance of purchase orders for products on giomoretti.com between users of the sites indicated above and the Seller.
The General Conditions of Sale do not regulate the supply of services or the sale of products by parties other than the Seller present on giomoretti.com via links, banners or other hyperlinks. It is up to the user to check the conditions of sale before placing orders and purchasing products and services from parties other than the Seller. Bronx s.r.l. Unipersonale company is not responsible for the provision of services by third parties other than the Seller or for the conclusion of electronic commerce operations between users of giomoretti.com and third parties.
1.2 The Seller uses the giomoretti.com website to offer products for sale and carry out its electronic commerce activities exclusively towards its end users or "Consumers", i.e. any natural person acting for purposes unrelated to their commercial, entrepreneurial or professional.
The Seller reserves the right not to accept order proposals received from users who are not "Consumers" or from any other person who does not comply with the relevant commercial policies.
2. Contract between Consumer and Seller
2.1 The reference language for signing the contract with the Seller is Italian.
2.2 Purchase requests from countries other than those indicated in the shipping country list cannot be accepted.
2.3 Consumers who intend to send a purchase order for one or more products on giomoretti.com must complete the electronic order form and transmit it electronically to the Seller following the online instructions to complete the purchase contract.
2.4 The order form contains a reference to these General Conditions of Sale, to the Privacy policies, as well as a summary of the essential characteristics of each product ordered and the relative price, the accepted payment methods and the delivery methods of the purchased products , shipping and delivery costs, return conditions.
2.5 Before proceeding with the purchase by transmitting the order form, the Consumer is required to carefully read the General Conditions of Sale and all legal documentation. We also encourage you to print, save or download a copy for personal use.
Before transmitting the order form, the Consumer has the possibility to verify the correctness of all the data entered.
By sending the order form, the Consumer declares to have understood and accepted its contents, as well as the General Conditions of Sale and Use, the Privacy Policy and the conditions for withdrawal. Failure to fully accept such contents will result in the cancellation of the order.
2.6 Product prices may be subject to revision. The Consumer is required to check the final price of each product before sending the relevant order form.
2.7 The Seller will receive the order form electronically and will verify the correctness of the data relating to the order before starting the purchase order processing procedure.
2.8 Acceptance of the order proposal by the Seller will take place when the Seller sends the interested party an email confirming the shipment of the order.
2.9 The order form will be archived for the period of time necessary to process the order and in any case within the terms established by law. The Consumer can review their order in their online account (if previously registered).
2.10 The Seller reserves the right to ignore or cancel any incomplete or incorrect purchase orders, the solvency of which is not sufficiently guaranteed or even if the products are not available. In such cases, the Seller will send the Consumer an email informing him that the contract has not been finalized, explaining the reasons.
If the products presented on giomoretti.com are no longer available or on sale at the time of the last access to the site or sending the order form, the Seller is required to communicate to the Consumer promptly and in any case within 14 days. starting from the day following the day on which the order was sent to the Seller, the unavailability of the products ordered. If the order is sent and payment is made, the Seller undertakes to refund the relevant amount, without any obligation of compensation.
3. Characteristics of the goods on sale
3.1 The giomoretti.com website offers only authentic, top quality branded products. These products are purchased directly from selected fashion houses, manufacturers and retailers.
3.2 The basic characteristics of the products presented on giomoretti.com are available on the specific page of each product. Please note that product images and colors may not exactly match the actual items due to your Internet browser or monitor.
4. Payments
4.1 The payment methods for the products purchased and the related shipping and delivery costs are indicated in the order form and constitute an integral part of these Conditions of Sale.
4.2 In case of payment by credit card, the financial information (for example, the credit/debit card number or the expiry date) will be transmitted in encrypted form to the providers of remote electronic payment services, without third parties being able to access this information in any way.
Furthermore, such information will not be used by the Seller except to complete the procedures relating to the purchase for which it was provided and to issue the relevant refund in case of return of the products, following the exercise of the right of withdrawal, or if it is necessary to prevent or report to the police any fraud detected on giomoretti.com. The amount for the purchase of the products and the shipping costs, as indicated in the order form, will be charged at the time of purchase or shipping, according to the payment methods selected.
The Consumer can also pay via PayPal or bank transfer.
4.3 The currency of the transaction will depend on the country of destination and will be clearly indicated in the order form.
5. Shipping and delivery of products
Products ordered on giomoretti.com will be shipped via DHL courier with Express service.
Delivery times are calculated based on working days and do not include national or local holidays.
Delivery costs are clearly indicated in the online order form, before the conclusion of the purchase contract.
It is possible to complete the order process only if the shipment is destined for one of the countries listed in the delivery countries menu. If the country of delivery is not listed, it is not possible to complete the order process as no shipments are made to that country.
If you change your shipping country during the order process, your cart will automatically empty and you will need to re-select the products on the correct country's website.
There may be remote or particular places to which DHL cannot ship; any limitations based on the delivery address will be communicated to the interested parties.
For some countries, the Consumer will have to pay any duties and/or taxes at the time of delivery; these amounts cannot be calculated before ordering. It is the Consumer's responsibility to inform himself and check with the local authorities/courier for any additional amount on the total order.
6. Right of withdrawal
6.1 In accordance with the Consumer Code, the Consumer has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) working days from the day of receipt of the products purchased on giomoretti.com.
At the moment it is not possible to make any exchanges of the articles. To change an item it is necessary to place a new order.
6.2 To withdraw from the contract, the Consumer must proceed as follows:
ensure that all the conditions set out below have been respected (6.6);
contact customer service at the email address customercare@giomoretti.com to receive the Return Authorization Code;
once the authorization code has been received, the withdrawal from the contract will be considered exercised and it will be necessary to send the return to the Seller within ten (10) working days of receiving the goods;
deliver the package to the courier according to the methods indicated in the following paragraphs.
6.3 The costs of returning the purchased goods are borne by the buyer.
6.4 If the Consumer decides to use the prepaid and pre-filled DHL label provided by the Seller, the seller will withhold a flat rate amount (as a return charge) from the refund of the returned product or products, equal to the shipping costs of the original order and any customs costs due by law.
6.5 If the Consumer decides to use a carrier other than that indicated by the Seller, he will have to pay the costs of returning the purchased products himself. In this case, any loss or damage to the products during transport will be borne by him.
6.6 The Right of Withdrawal, including all the terms and methods described in the previous and following paragraphs, is considered exercised correctly if the following conditions are also fully respected:
the return authorization request must be sent to the Seller, by contacting Gio Moretti customer service, within fourteen (14) days of receiving the products;
the products must not have been used, worn, washed, damaged or modified in any way;
the identification tag must still be attached to the products with the disposable seal which constitutes an integral part of the product;
the products must be returned in their original packaging and complete with any accessories or additional packaging;
the returned products must be delivered to the courier within ten (10) days from the explicit confirmation of authorization for the return by Gio Moretti customer service (the authorization is considered confirmed only when the Return Authorization Code is received from customer service , which will be indicated on the DHL return label).
6.7 Where the Right of Withdrawal is exercised according to the methods and terms indicated, the Seller undertakes to reimburse the payments already received for the purchase of the products according to the methods and terms established.
The amounts will be refunded as soon as possible; in any case, once the correct execution of the return procedure has been verified, the Seller undertakes to activate the refund procedure within thirty (30) days from the date of arrival of the goods in the warehouse.
6.8 In case of failure to comply with the methods and terms for exercising the right of withdrawal, as specified in these conditions of sale, the Consumer will not have the right to obtain a refund of the sums paid to the Seller; he may, however, at his own expense, request that the products be sent back to him in the state in which they were returned to the Seller. Otherwise, the Seller may retain the products, as well as the sums already paid for their purchase.
7. Refund times and methods
7.1 After returning the products, the Seller will carry out all the necessary checks to verify the conformity of the products themselves with the terms and conditions referred to in paragraph 6.
In the event of a positive outcome of these checks, the Seller undertakes to send the Consumer an email confirming acceptance of the returned products.
7.2 The refund will be credited exclusively to the same debit/credit card/PayPal account/bank account used for the original payments of the order.
7.3 The Seller specifies that the carrier for returning the products must be the same as the one that made the delivery (DHL), so that, using the pre-printed label affixed to the package containing the products, the Consumer can return the products to the Seller without having to pay shipping costs directly. According to the methods and terms established for the right of withdrawal, this method allows the Seller to pay directly, on behalf of the Consumer, the costs of returning the purchased products, freeing him from any payment obligation towards the carrier.
If the Consumer decides to use a carrier other than the one indicated by the Seller to return the products, he/she will have to pay the necessary expenses himself and will also have to assume all responsibility for any loss or damage to the products during transport, according to the methods and within the terms established for the exercise of the right of withdrawal.

9. Applicable law and dispute resolution
9.1 The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005 on the Consumer Code, with specific reference to the legislation on distance contracts and Legislative Decree no. 70 of 9 April 2003 on some aspects relating to electronic commerce.
10. Changes and Updates
The General Conditions of Sale may be changed at any time, also in consideration of any changes in the law. The new General Conditions of Sale become effective from the date of publication on the site.
